Cloud Raptor Acceptable Use Policy
This Acceptable Use Policy (AUP) outlines the rules and guidelines that all Clients of Cloud Raptor's Systems and Services must adhere to. Failure to comply with these rules may result in suspension or termination of your access to Cloud Raptor’s Services, as well as legal action in certain cases.
Terms defined in the Master Services Agreement (MSA) and/or Service Level Agreement (SLA) have the same meaning when used herein unless expressly provided otherwise.
1. PROHIBITED ACTIVITIES
The following activities are strictly prohibited when using Cloud Raptor's Services:
1.1. Illegal, Abusive, or Irresponsible Behaviour: This includes any activity that violates applicable laws or regulations, as well as behaviour that may be deemed morally reprehensible or harmful to others. Some of these activities include:
- 1.1.1. Sending unsolicited bulk email or other forms of spam (large volumes of unwanted email messages).
- 1.1.2. Conducting any activity that violates the privacy of others or infringes on their rights, such as unauthorized access to personal information.
- 1.1.3. Hacking, phishing, or attempting to gain unauthorised access to any computer system or network.
- 1.1.4. Distributing malware, viruses, or engaging in any activity intended to damage, disrupt, or cause harm to any system or network.
1.2. Malicious and Offensive Content: Clients are prohibited from publishing, transmitting, or storing any content (or links to content) that is illegal, offensive, defamatory, malicious, fraudulent, or morally repugnant.
1.3. End of Life (EOL) Software: End of Life (EOL) operating systems or software are not permitted on Cloud Raptor's Systems and Services. Such systems are vulnerable to unknown and unpreventable vulnerabilities that put both the Client and Cloud Raptor's systems at risk. Clients are responsible for ensuring that any device or network within their control is properly secured.
1.4. High-Risk Use: Cloud Raptor's Services must not be used in any situation where the failure or fault of the Services could lead to death, serious bodily injury, physical or environmental damage, or any other form of activity that is considered illegal or unethical.
1.5. Probing and Scanning: Any attempt to probe, scan, penetrate, or test the vulnerability of a Cloud Raptor system or network, or to breach Cloud Raptor's security or authentication measures (whether by passive or intrusive techniques) is strictly prohibited. Clients must obtain prior written consent from Cloud Raptor before conducting any penetration testing on their own Hosted System.
1.6. Intellectual Property Infringement: Clients are prohibited from using the Services to infringe on the rights of a third party in any work protected by copyright, trade or service mark, invention, or other intellectual property. The Client may not use the Services to publish another person's trade secrets or to publish information in violation of a duty of confidentiality.
1.7. Intrusive Activities and Anonymisation: Clients are prohibited from using or allowing the Services to be used for intrusive activity, including port scans, sniffing, spoofing, or any other activity that may be deemed contentious. Anonymization services or public proxies (such as VPN, Tor, P2P, or IRC), as well as card sharing, crypto-currency mining, video game bots, and other similar activities are strictly prohibited.
1.8. Illegal Content: Clients are prohibited from hosting, distributing, or linking to any illegal or infringing content, including pirated software, copyrighted material, or pornography.
1.9. Shared Resource Abuse: Clients are prohibited from using any shared system provided by Cloud Raptor in a way that interferes with its normal operation or disproportionately consumes its resources, including activities that may slow down or disrupt the performance of the shared system.
2. LAW ENFORCEMENT AND INVESTIGATIONS
Cloud Raptor reserves the right to report any conduct by the Client that is believed to violate applicable laws. In such cases, Cloud Raptor may provide any information it has about the Client, including their traffic and the content stored on Cloud Raptor's systems. Cloud Raptor will fully cooperate with any law enforcement or regulatory agency in their investigation of such conduct and will respond to any formal request in a civil action that meets the requirements for such a request.
3. CLIENT ACCOUNTABILITY AND SECURITY
3.1. User Accountability: Clients are responsible for ensuring that anyone using their Services, whether authorized or unauthorised, complies with this AUP. If anyone using the Services violates the AUP, the Client is responsible and faces consequences. Using the Services to assist a third party in activities that violate this AUP is also deemed a violation.
3.2. Account Security: Clients are responsible for maintaining the security of their accounts and must take reasonable measures to prevent unauthorised access or use. This includes using strong passwords, regularly updating software, and securing any devices used to access the Services. Any suspected security breaches or unauthorized access must be reported to Cloud Raptor immediately.
3.3. Reporting Violations: Clients are encouraged to report any suspected violations of this AUP to Cloud Raptor as soon as possible, including the nature of the violation, the identity of the involved parties, and any supporting evidence.
4. ENFORCEMENT AND CONSEQUENCES OF BREACH
4.1. Monitoring: Cloud Raptor reserves the right to monitor its Services for compliance with this AUP.
4.2. Suspension and Termination: If a Client breaches this AUP, Cloud Raptor may, at its sole discretion, suspend or terminate their Services without notice. Cloud Raptor may also intercept, remove, or block any content or traffic belonging to the Client or their end-users if it is being used unlawfully or in violation of this AUP.
4.3. IP Reputation and Blacklisting: If a Client's activities cause Cloud Raptor's IP addresses or Autonomous System Number (ASN) to be placed on any global blacklists or blocklists, Cloud Raptor reserves the right to suspend services immediately and bill the Client for any costs associated with remediation and delisting.
4.4. Forfeiture of SLA Credits: If a Client violates this AUP, they will not be eligible for any credits under the Service Level Agreement (SLA) for any service interruptions or downtime resulting from their AUP violation or subsequent suspension.
5. LIMITATION OF LIABILITY
Cloud Raptor shall not be liable for any damages or losses arising from the use of its Services, including, but not limited to, loss of data, loss of revenue, or other economic loss. Cloud Raptor shall not be liable for any indirect, incidental, or consequential damages, whether based on negligence or otherwise, resulting from the enforcement of this AUP.
6. MODIFICATIONS TO THIS POLICY
Cloud Raptor reserves the right to modify this AUP at any time. The most current and binding version of this policy will always be maintained online at https://cloudraptor.co.bw/aup. Clients are responsible for regularly reviewing the online policy to ensure compliance with the latest version. Continued use of Cloud Raptor's Services thirty (30) days after an update is published to the website constitutes your acknowledgment and agreement to comply with the most current Acceptable Use Policy.
